User Agreement

1. Acceptance of Agreement

By accessing or using AerGame ('Service'), you agree to be bound by this User Agreement ('Agreement'). If you do not agree with any provision of this Agreement, you must not use the Service.

2. Account Registration and Security

a.You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
b.You agree to notify us immediately of any unauthorized use of your account or any breach of security.
c.You must be at least 13 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian.

3. Community Standards

You agree to comply with the following community standards when using the Service:

-Be respectful of other users. Personal attacks, harassment, hate speech, bullying, or discrimination based on race, gender, religion, nationality, or any other characteristic are strictly prohibited.
-Do not post or share content that is illegal, harmful, or violates the rights of others, including copyright infringement.
-Do not spam or engage in fraudulent activities, including phishing, scam, or deceptive practices.
-Do not use automated tools, bots, or scripts to interact with the Service without our prior written consent.
-Do not attempt to gain unauthorized access to the Service, its servers, or user accounts.

4. User-Generated Content

a.You retain ownership of any content you post, upload, or share on the Service ('User Content'), including comments, reviews, ratings, and other materials.
b.By posting User Content, you grant AerGame a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, distribute, and display such content within the Service for the purpose of operating and improving the platform.
c.You are solely responsible for your User Content and ensure it complies with this Agreement and all applicable laws.
d.We reserve the right to remove or modify User Content that violates this Agreement without prior notice.

5. Intellectual Property

a.All intellectual property rights in the Service, including but not limited to trademarks, copyrights, patents, and trade secrets, are owned by AerGame or its licensors.
b.You may not use, reproduce, or distribute any part of the Service without our prior written consent.
c.Game assets, including images, videos, and audio, remain the property of their respective game developers.

6. Prohibited Conduct

The following activities are strictly prohibited on the Service:

-Engaging in any illegal activity or violating any applicable law.
-Harassing, threatening, or harming other users.
-Posting sexually explicit, violent, or discriminatory content.
-Distributing malware, spyware, or other harmful software.
-Manipulating game rankings, leaderboards, or engagement metrics.
-Impersonating another user or entity.

7. Enforcement

a.We reserve the right to enforce this Agreement at our sole discretion.
b.Violations may result in: warning, temporary suspension, permanent ban, removal of content, or legal action.
c.We may also report illegal activity to law enforcement authorities.

8. Dispute Resolution

Any dispute arising from or related to this Agreement or your use of the Service shall first be submitted to good-faith negotiation. If the dispute cannot be resolved through negotiation, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association.

9. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. You irrevocably consent to the exclusive jurisdiction of the courts located in California, USA for any legal proceedings arising out of or related to this Agreement.

10. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will provide at least 30 days' notice of material changes by posting the updated Agreement on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Agreement.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of this Agreement. Upon termination, all licenses granted to you under this Agreement shall cease.
